A former Boston cop who is suing over his firing for refusing both Covid-19 shots and tests last week demanded that the judge in the case recuse herself because her husband is the CEO of a company that made devices used in early Covid-19 testing and so she has an undeniable bias.
In a ruling today, US District Court Denise Casper refused, and only partly because Marc Casper's company, Thermo Fisher Scientific, has nothing to do with the issues Saviel Colón's suit raises:
Although the work of TFS has no bearing on the resolution of claims in this matter, the Court notes that the undersigned judge has been divorced for over a decade.
In addition to attacking a judge for work done by a man she hasn't been married to for a decade, Colón used his affidavit to claim that Boston Public Health Commission Executive Director Bisola Ojikutu discriminated against Black people like him by writing about particular Covid-19 health and treatment issues in the Black community.
Ojikutu herself is Black.
This is Colón's third Covid-19 suit against the city. In addition to a similar case he filed in Suffolk Superior Court, he was also a plaintiff in a suit brought over the city's three-month-long requirement to show proof of Covid-19 vaccination to get into certain public areas; in his case, the Franklin Park Zoo.
The judge in that federal case dismissed the entire complaint; in Colón's case, she said he had failed to provide proof he and his family had actually been turned away at the zoo.
